Chinese Legal System in Construction Quality Test Industry

分析了我国已出台涉及建设工程质量的法律法规及部分规范性文件,理清了现行建设法律法规的基本架构,从立法、行政管理体制和司法仲裁鉴定等角度分析了工程质量检测行业法制化建设存在的问题,并予以举例说明.在此基础上,提出了加入WTO的过渡时期,我国建设工程质量检测行业法制化建设的改革建议,为我国工程质量检测行业管理体制和运行机制的改革提供了理论依据.

This article analyzes the current legal system and some criterion documents in construction quality test industry of China,and then builds the basic framework of construction law,identifies the issues of the legal system construction of construction quality test industry at the aspect of lawmaking,administration management system and judicial arbitration judgment etc..Some examples are given to illustrate issues.Based on the analysis ahead,some recommendations for the reform of Chinese legal system of construction quality test industry during interim period are provided to academic foundation for the reform of management system and mechanism of construction quality test industry.
