“特保条款”及其对我国出口贸易的负面影响评析

Comment and Analysis on Special Safeguard Provisions and Their Unfavorable Impacts on China's Export Trade

“特保条款”是世贸组织保障机制的重要组成部分。中国《入世议定书》和《工作组报告书》中的“特保条款”具有专门适用于中国的特定性、单向性与歧视性。在这些“特保条款”的过渡期限内,任一世贸组织进口成员都可以针对给其造成或威胁造成市场扰乱的某一中国出口产品提起“特保”立案申请,这就必然会给我国的出口贸易带来不利影响。本文在比较分析各类保障条款的基础上,对“特保条款”的适用现状与不利影响进行分析与评价,并提出若干应对措施。

Special safeguard provisions are important parts of WTO's safegu ard mechanism. The Special safeguard provisions in'the Protocol on the Accession of China'and'The Report of the Working Party on the Accession of China'are spec ially and unilaterally applying to China and with discrimination. In the transit ional period, any WTO import member can apply for placing a special safeguard ca se on file if they consider that a product from China has caused or threaten to cause market disruption. This inevitably brings some unfavorable impacts on chin a's export trade. This paper compares and analyzes different kinds of safeguard provisions, on this basis, this paper analyzes and comments on present situation of application of the provisions and their unfavorable impacts, as well as puts forward some countermeasures.
