行政权推定行使,已成为行政权越权、滥用的基本口实。本文从权力不得推定出发,阐明了行政权不得推定的理由依据,指出其现象表现。并在此基础上,提出行政权法定,为行政权的行使设定了基本界域。

The presumption of administrative authority has become an important factor of the ultra vires and abuse. In this thesis, the author expounds the foundation of the theory of no presumption of administrative authority and its behavior. On that basis, the author discusses the legitimation of administrative authority and the boundary of execution.
