浅析我国行政复议制度的不足与完善

Brief Analysis of Defects and Perfection of Chinese Administrative Reconsideration System

行政复议制度是行政救济制度的重要组成部分。这一制度对于保护行政相对人合法权益,监督行政主体正确行使行政职权,维护社会公正与安定有着重要意义。实践中,我国的行政复议制度在社会生活中发挥着积极作用,但还存在着一些缺陷,需要不断发展和完善。设立独立的复议机构,逐步推进行政复议审查中立,取消行政复议终局,加强对行政复议的司法监督,这将有助于完善行政复议制度,更好地发挥行政复议制度的作用。

The system of administrative reconsideration is an important part of administrative relief system. This system has great significance in supervising the administrative organs to exercise the administrative power correctly ,protecting administration’s relative people’s legitimate rights and interests, maintaining social justice and stability. In practice, the administrative reconsideration system of our country is playing a positive role in social life, but this system still has some defects. So it needs developing and perfecting constantly. It will be helpful to perfect the system of administrative reconsideration by setting up independent reconsideration organization, advancing the administrative organs to examine neutrally, canceling the system of administrative reconsideration end and intensifying the judicial supervision of the administrative reconsideration.
