证据的适格性是判断诉讼中的某项证据是否具备法定资格的依据,其判断标准是合法性和关联性,其作用是确定证据调查的范围,并为进一步对进行证据证明力的评价和判断提供必要前提。证据适格性虽与英美法中的证据可采性属于同一范畴的概念,但实质内容并不完全等同。

The function of the qualification of evidence rule is to determine whether any evidence satisfies legal requirement for restriction, so it may ascertain the scope of investigation of evidence and provide precondition for evaluating evidential effect. As the criterion of qualification of evidence is legality and relevancy, it is actual different to admissibility of evidence in common law although both the conceptions belong to same category.
