原产地名称是以地理标志为依托而设定的一项识别性权利。在商品经济条件下,一个有信誉的原产地名称在市场竞争中具有相当重要的作用。针对我国在原产地名称保护中存在的问题及保护现状,文章提出,现阶段应统一把原产地名称的保护纳入商标法范畴,严格原产地名称使用的准入制度,建立原产地名称使用者之间的损害赔偿制度。

The appellation of origin is an identification right which is based on the geography. Under the market economic circumstances, a famous appellation of origin plays an important part in market competition. Facing these problems, the article points out that, it’s expected to adopt it to the law of trade mark, make it difficult to use it, and establish the user’s mutual compensation for damage.
