摘要
关于悬赏广告的法律性质,在法学理论界和司法实践中的争论由来已久。如何定性取决于保护行为相对人的价值理念,从而在法律上构建一套有利于保护行为相对人的悬赏广告的法律制度。文章通过对不同学说的利弊分析,认为悬赏广告定性为单方民事法律行为,才更有利于保护行为相对人和体现民法基本原则。
For controversies over legal nature of reward-offering advertisement,as opinions vary,no unanimous conclusion can be drawn,and how to determine the nature depends upon the values of protecting behavioural opponent,thus forming a set of legal provisions concerned reward-offering advertisement favourable to protecting behavioural opponent in law.By means of analysing the advantages and disadvantages of different doctrines,the nature of reward-offering advertisement is defined as a unilateral civil legal act.This is more favourable to protecting behavioural opponent and reflects value of civil law's basic principle.
