论以人为本司法观的理论基础——从新宪法修正案谈起

On the Theoretical Foundation of the People-oriented Judicial View

我国2004年宪法修正案已经为以人为本司法观的构建奠定了宪政基础。以人为本司法观要求现代司法珍惜人的生命和自由,保护人的财产,重视人的精神利益。它是人类文明进步的理性要求,其理论基础包括:现代法治理论、程序主体性理论和权力与权利的关系理论。以人为本司法观是判断司法是否公正和是否有效率的根本依据,而司法公正与司法效率则是以人为本司法观的具体化。

The 2004 constitutional amendment has built up the constitutional foundation for the people-oriented judicial view. This judicial view claims that modern judicature cherishes people’s life and freedom, protects people’s property and thinks much of people’s psychic profit. It is the rational requirement of human civilization and its theoretic foundation includes the theory of modern legal rule, the theory of procedural subject and the relational theory of power and right. The new judicial view is the fundamental basis to estimate judicial justice and efficiency, while judicial justice and efficiency is the embodiment of the people-oriented judicial view.
