少数民族法律文化形态与现代化——以云南少数民族村寨为例

State of Legal Culture of Ethnic Groups and Modernization——Taking Ethnic Villages in Yunnan Province as an Example

中国的法制现代化进程不能忽略少数民族地区的法制现代化问题。面对现代型的国家制定法的冲击,民族民间法将怎样完成从传统型向现代型的转化呢?本文试图从分析传统的少数民族的法律形态以及法律文化的特点入手,借用法制现代化发展模式的分析进路,对少数民族法律的转型进行比较研究,指出在民族民间法向现代型法律的转化过程中不能忽视本民族的法律文化传统,以及在这个转化的过程中应注意的几个问题。

In modernization of Chinese legislation, legal modernization of ethnic groups should not be neglected. Starting with the analysis of the legal state and legal culture of ethnic groups, this paper makes a contrastive study of transition of law of ethnic groups. It is pointed out that the native legal culture tradition should not be overlooked and some issues should be emphasized in this transition.
