摘要
近几年来,关于工伤认定的行政诉讼案件迅猛增长,成为行政审判的一大热点和难点。该类案件的主要法律问题有:适用范围不明确;法律冲突现象突出;对认定条件的理解不一致;在诉讼程序方面有所冲突,等等。对此,有关部门首先应当完善法律规定,统一处理标准;同时,可以考虑将行政机关的工伤认定定性为一种证据,由法院在因工伤而产生的损害赔偿民事诉讼中予以审查,此类案件主要通过民事诉讼解决。
The cases of determining injuries at work have increased greatly and become a focus and also a rub in recent years. The main legal problems include: the scope of application is not clear; corresponding laws are in conflict; the understanding of conditions for appraisal is not in accordance, existence of inconsistencies in litigation procedures, etc. To solve these problems, related agencies should perfect the legal provisions and unify the standards. The court may try to accept the determination of administrative agencies as evidence and hold the cases in civil procedures.
