摘要
分析我国研究和制定行政程序法过程中有关基本原则问题存在的争议及产生争议的原因,同时,借鉴国外和我国台湾、澳门地区行政程序法的立法实践经验,探究其有关基本原则的立法模式、内容选择的时代背景,进而提出我国行政程序法基本原则立法应采取直接表达的模式进行,不宜将行政法的价值目标规定其中,也不宜具体区分上位原则和下位原则。主张在我国社会发展的特定时期,应确立以公正与效率的平衡为价值取向的行政程序法基本原则,其内容应当是充分反映行政程序法自身特点的公开原则、参与原则、正当程序原则、比例原则、守信原则、及时原则。
The article analyzes the dispute of basic principles and its cause in the process of studying and drafting administrative law. Meanwhile, according to the legislative practice of Taiwan, Macao and other countries, it probes into the legislative model and the legislative background, and puts forward that we should adopt a direct model for legislation, which is not suitable for including the value target of administrative procedure law, or concrete up principles or down ones. It asserts the basic principle with a balance of fair and efficiency be set up, whose content shows the characteristics of its own, that is, public, participating, due process, proportion, punctual and timely principle.
