浅谈我国宪法实践性的现状

A Preliminary Discussion about the Present Situation of the Practicality of Chinese Constitution

宪法是国家的根本大法,宪法的贯彻和实施状况是一个国家实现法治的关键。改革开放以来,我国法制建设取得了很大成效,党和国家非常重视宪法建设,法律界人士积极推动宪法实践性的发展。随着普法教育的加强,人们的法治观念不断增强,普通公民也加入其中,成为推动宪法实践性的强大力量,我国宪法实践性取得了新的进展。但是,宪法规范在实际中并不能完全得以实施,主要存在两个方面的问题:一是宪法进诉讼尚未被普遍认可,二是违宪审查制度尚未完善。

The constitution is the fundamental law of a country. The carrying out of the constitution is the key to its enforcement. Since the reform and the open-door policy were carried out, our country has achieved a great success in the construction of the constitution. Our party and our country attach great importance to the construction of the constitution, and figures in the field of law take vigorous actions to expand the development of the practicality of the constitution. Furthermore, with the strengthening of common law education, people’s sense of law is increasingly enforced. Meanwhile the common citizens are involved in the construction of the constitution, which is the great power to promote the practicality of the constitution. Therefore, our country has made a new progress in the practicality of the constitution. However, the standards of the constitution can not be completely put into effect in reality. There are two major problems: one is that it is not universally accepted that the constitution enters lawsuits, the other is that unconstitutional examination system has not been perfected.
