On the Right to Silence

沉默权,是指犯罪嫌疑人在接受警方讯问时保持沉默不语的权利。沉默权有利于保护人权,遏制刑讯逼供、暴力取证。然从各方面情况看,我国目前尚不具备立即引入沉默权的条件,但从现在开始我国就应该着手创造条件,争取尽早引入沉默权以从根本上杜绝刑讯逼供,建立科学完善的法律制度。

The right to silence is a legal protection enjoyed by crimnal suspects undergoing police interrogation or trial. The right to silece is favorable to protecting human rights and preventing the use of tortue and coercing to get confessions. As things stand, China is not in a position to introduce the right to silence immediately, but we shoud set out to create the conditions for its earliest introduction so as to essentially eradicate the use of tortorture to extract confessions and to establish a scientifically perfected legal system.
