从刑罚人道主义看死刑

Remark Death Penalty Through Penalty Humanism

死刑存废本身不能表明一国的刑罚人道与否,笼统的讨论死刑存废是基于刑罚人道主义的考虑的提法是值得商榷的;如果仅仅是出于刑罚人道主义的考虑的话,一个国家有权也应该根据国情选择保留或者废除死刑。当然,由于死刑的严厉性,如果规定和适用不当,更容易引起违背刑罚人道主义的情形,因此各国对于死刑的规定和适用都应慎重。

Whether death penalty should be abolished or not in itself can not indicate whether the penalty in a country is humanitarian or not . It is open to question to discuss generally whether death penalty should be abolished or not in the consideration of penal humanism . If only considering penal humanism, one country has right to make a choice between keeping and abolishing death penalty according to its own conditions . Simultaneously, because death penalty is severe, if its stipulation and applying is not correct, it is very easy to cause the result of violating penal humanism , so prudence is needed when stipulating and applying.
