通过研究中国民航法、合同法、民航规章中关于航班延误的法律规定,联系现有有关航班延误处理中中央和地方政府的政策,参照国际公约以及美国和欧洲的相关法律规定,分析了航班延误的法律责任,并结合中国国情对航班延误处理的政策立法提出有实用价值的建议。

<Abstrcat> Delays of flights can bring about many disputes between air carriers and passengers. To settle the disputes, the government should make some relevant policy and legislation. The paper, focusing on the carrier's compensation liability from flight delay according to the relevant domestic laws and the international practices, analyzes the respective rights and duties to be undertaken by air carriers and passengers, and accordingly on this topic, the paper puts forward some constructive suggestions.
