伦理笼罩下的法秩序——中国封建法律文化的伦理主义特征

The Law Order under the Ethics——Ethics Features in Chinese Feudal Law Culture

中国封建法律文化具有鲜明的伦理主义特征,从立法、释法到司法,从定罪、量刑到执行,无不浸透着“三纲”“五常”的伦理主义的精神,体现着“忠”“孝”“节”“义”的要求。从生产方式、社会组织、政权结构和意识形态等方面分析了传统的伦理主义法律文化的背景成因,用“礼”的内容和精神分析了伦理主义法律文化的实质内涵,并从立法、释法、司法各个方面介绍了这种文化特征的具体表现。

There are marked ethics features in Chinese feudal law culture. In view of legislation,law interpretation and judicature and penalty convicting,measuring and carrying out the law,it is imbued with ethics spirit of“Three Cardinal Guides”and “Five Constant Virtues”,and it embodies the requests of Loyalty,Filial Piety,Moral Integrity,and Chivalry. This paper analyzes the background causes of traditional ethics law culture from many aspects,such as the mode of production,social organizations,power structure and ideology. And the paper also analyzes the connotation of ethics from the content and spirit of “courtesy”,and introduces the concrete presentation of this cultural feature from legislation,law interpretation and administration of justice.
