人格尊严是公民最基本的宪法权利,人应该得到尊重。国家赔偿中包括对人格尊严侵害的精神赔偿是时代发展的趋势。目前,我国的《国家赔偿法》对人格尊严的保护存在着严重的缺陷,要改变现状,必须在赔偿范围和赔偿方式上进一步完善。

Human dignity,the most essential constitutional right for citizen,should be respected. There are serious defects in Chinese “State Compensation Law” concerning human dignity. To change the current situation calls for further improvement of compensation scope and compensation method. It is the era tendency for the state compensation including dignity insult compensation.
