论汉朝法律儒家化的体现

On the Outset of the Confucianization of Laws in the Han Dynasty

法律儒家化是中国古代法律发展的一个重要过程,儒家思想向法律的渗透影响着中国法律的走向,汉朝是法律全面儒家化的开端。本文从立法思想、法律解释、法律内容和司法制度等四个方面对汉朝法律的儒家化进行阐述。

Confucianization of law is an important process in the development of ancient Chinese law. The penetration of Confucian thoughts towards the law affects the development orientation of Chinese law, and the Han Dynasty is the outset of the thorough Confucianization of law. This paper expatiates the Confucianization of law in the Han Dynasty in four aspects: legislation thought, explanation of the law, the contents of the law, and judiciary.
