On the Character of the Legal Relationship

以思想社会关系与物质社会关系作为分析工具以给法律关系定性,就必须正确理解思想社会关系与物质社会关系。思想社会关系是由意志行为所形成的社会关系;物质社会关系是思想关系背后的规律性联系。任何社会关系都是同时是思想社会关系与物质社会关系,法律关系也是如此。

To define the character of the legal relationship of the social relati on of thought and the material as the analytical tool composing, we should corre ctly understand the two relations. The social relation of thought is caused by v olitional acts, while the one of material is a regulation contact behind it. Lik e all of social relations, legal relations are either social relations of though t or material.
