商标反向假冒的法理分析及其法律规制

反向假冒相对于正向假冒更加隐蔽,危害更大。法律调整商标反向假冒行为有正当的法理基础,对该行为的规制应结合其性质进行,我国《商标法》对反向假冒的规定也应进行扩张解释。

Inverse passing-off has serious effect. It's nessisary to analyze juri sprudentially the unity of trademark and commodity, the efficacy of simultaneous existence of the right of trademark and commodity, the mistake of 'exhaustion o f right'. Inverse passing-off should be forbidden and an expansive interpretatio n should be given to the definition of inverse passing-off.
