完善医疗事故立法方略初探

An Approach to Perfection of the General Plan for Legislation on Medical Malpractice

从法理与实践结合上,就1987年国务院发布的《医疗事故处理办法》中的某些问题进行了探讨,并就完善医疗事故立法方略提出了四点建议:(1)建立医疗事故行政仲裁制度;(2)改进医疗事故技术鉴定制度;(3)建立医疗事故保险制度和完善社会医疗保险制度;(4)加强行医资格的管理。

From the perspective of combination of legal principles and medical practice, the article discusses some points in the 'Handling of Medical Malpractice 'issued by the State Council in1978,and makes an approach to perfection of the general plan for legislation on the malpractice, with putting forward four suggestions : (1 ) implement the administrative arbitration system of the malpractice, (2)improve the technical judgment system of the malpractice, (3)practise the insurance system of the malpractice, and (4) strengthen the management of qualifications for practising medicine.
