进入新的世纪以来,生物技术产业成为生产力发展的朝阳产业,在技术研究成果不断发展的同时,对规范的要求也日益迫切,特别是在各国生物技术发展水平极不均衡的现实条件下,国际间有关生物技术保护规范的形成和统一成为国际法研究的新热点。其中关于植物新品种之保护,基于事实及政策面之特殊考量,在保护方式及强度上具有特殊性,因此在各国立法上有单独立法予以保护之趋势,文章旨在比较各国相应制度,并分析国际上对植物新品种保护的现状及趋势。
