Discussion of mental damage compensation is more and more in recent years, but the compensation quantum is a complex both in substantial law and procedural law. This article puts forward a new standpoint in deciding the quantum of mental compensation. The method of social survey is suggested, and the basic formula for calculating the compensation quantum is listed according to certain basic principles.
