摘要
1997年修订颁布的新刑法,确立了罪刑法定原则。但仍需要面对“法有限”和“情无穷”的矛盾。解决之道在于合理运用刑法解释方法类推解释、扩张解释与类比解释。
The Criminal Law, amended and promulgated in 1997, established the principle of a legally prescribed punishments for a special crime (搕he Principle?. While we have to face the contradiction of 搕he limitation of law?and 搕he endless of conditions? It is the way to solve this problem that we can use explanation method in criminal law, the analogy explanation, the amplified explanation and the substantial analogy explanation.
