试论中国近代法制转型的起点与特点

On the Starting Point and Characteristics of the Transformation of Legal System in Chinese Modern Times

本文就中国法律近代转型的起点提出新的见解,认为第二次鸦片战争后,中国传统法律开始向半殖民地半封建法律制度转型。中国法律近代化的道路开始起步。持续到19世纪末。20世纪初,清末的立宪修律形成了中国法制近代化的新阶段。伴随半殖民地半封建法律制度的形成。中国的近代法制却始终没有走上完全资本主义化的轨道。

In this essay, the writer tries to bring up the new views on the starting point of the transformation of modern times of Chinese law: After the second Opium War, the Chinese traditional law began to transfer to the legal system of semi-colony and semi-feudal, which means the beginning of the modernization of Chinese law. Till the late 19th century to the early 20th century, the constitutionalism and amendment in late Qing Dynasty formed the new stage of modernization of Chinese legal system. With the formation of semi-colony and semi-feudal legal system, the legal system of Chinese modern times, however, didn't get onto the track of full capitalization.
