Research on the Law Protection of Virtual Property on Network:Around Constitution Law

在互联网飞速发展的今天,虚拟财产问题日益引起人们的重视。然而,透过诸多案例,显示出了法律在虚拟财产保护方面的缺失导致了保护的不力。在对虚拟财产进行法律性质分析的基础上,网络虚拟财产亦应属于宪法财产权保护的范围。因此,较为有效的保护方式是通过宪法解释进行高度原则性保护,同时由各个部门法从各个侧面对此进行全面的辅助和支撑。

With the wide use of the Internet,the protection of the virtual property is more and more important. However, from many cases, we can see the lack of responding law leads to the poor protection. Based on the research of character of virtual property, virtual property is also the property protected by Constitution Law. Therefore the effective way is the protection of constitution at a high level, and supported by the branch laws from each own standpoint.
