摘要
诸多商家在认定自己享有“最终解释权”的前提下推出了诸多促销活动,并获得了一定的利益。但事实上,某些商家的行为在很大程度上违背了诚实守信原则和法律规定,严重污染了消费环境。应如何理解“最终解释权”?本文从事实和法理角度对此现象与本质、适用法律与法理进行阐析,从而得出结论:“最终解释权”应由司法机关依法解释。
Many businessmen believe that they enjoy the final interpretation right to sales promotion and hold many sales activities to attain benefits. However, some businessmen breached the principle of honesty or certain law, thus stained the consumption market. How should we comprehend the final interpretation right? The article explains the essence, suitable laws and legal principles about the final interpretation right in sales promotions and concluds that the final interpretation right should belong to judicial organs.
