法官弹劾制度刍议

Modest Proposal for the System of Judge Impeachment

法官身份保障制度是司法独立的基础,法官弹劾制度是实现法官身份保障的一个重要的环节。笔者从明确法官弹劾的概念入手,在比较美国、德国、日本三种不同的法官弹劾模式的基础上,对我国现行有关法官免职制度进行分析,结合我国实际与他国经验,对于我国法官弹劾制度的构架提出一些思考,认为法官弹劾制度的建立必须以法为据,其实行应有法定的启动原因为前提,以专门机关的实施为条件。

It is the basis of judicial independence to safeguard judge's status and the system of judge impeachment is one crucial element to make it a reality. The author analyzes the current judge relieving system of our nation by firstly defining the concept of judge impeachment on the basis of comparing different models of America, Germany and Japan. Then some ideas are advanced for the structure of judge impeachment, from which the system of judge impeachment should be established legally, implemented legally and enforced by special agency.
