治权与职务犯罪预防

On Administering Power and the Prevention of Official Crimes

职务犯罪是权力行使者超越权力、滥用权力、放弃权力行使的表征,是权力商业化运行、垄断运行、无职责意识运行的结果。治权可以通过法律和制度约束、限制、控制权力的行使,预防和减少因权力滥用而滋生的职务犯罪。依法治权是依法治国的重要内容之一,建立权力制约制度,建立检察机关指导预防职务犯罪制度是通过治权预防职务犯罪的可选择方式。

Official crime is the token of exceeding,abusing and abandoning the authority by the exerciser,as well as the conse- quence of commercial,monopoly and irresponsible operation of power.Implementation of administering power will limit,re- strict and control the exertion of power with laws and regulations,and prevent and reduce the official crimes caused by abusing power.Administering power according to law is one of the important contents of administering a country in accordance with law,and establishing the power restriction system and guiding system of preventing official crimes of procuratorial organ are fea- sible measures of the prevention of official crimes by administering power.
