摘要
比例原则是西方国家公法上的一项重要原则,它对防止国家权力的滥用和保护公民个人权利具有非常重要的意义,许多国家和地区都在立法、行政和司法领域加以贯彻,然而在我国的公法领域特别是在刑事诉讼法上这项原则还没有引起足够的重视。在刑事诉讼过程中刑事强制措施作为保障诉讼正常进行的重要手段,其实施和运用对公民私权利构成了巨大的威胁,比例原则的引进就显得尤为必要。
The principle of proportion is significant in the western countries′ public law. It′s meaningful to prevent a state′s powers from being misused and protect the citizens′ private rights. Many countries and areas have been carrying it on in the fields of legislation, the executive and judicature, while it has not been paid enough attention in China. Criminal compulsory measures can act as an important method to protect the normal operation of procedure, but during criminal procedure it has threatened citizens′ private rights. Thus, it is very important to introduce the principle of proportion.
