交通肇事罪逃逸问题研究

On Problem of Abscond from Traffic Offence

我国《刑法》以及最高人民法院关于交通肇事罪的《解释》中规定,对因逃逸致人死亡以及交通肇事后指使肇事人逃逸,致使被害人因得不到救助而死亡的,以交通肇事罪共犯论处。该规定存在诸多可商榷的地方。

According to the Criminal Law and the Interpretation of the traffic offence drafted by the supreme court,the one,who abet the offencer to abscond , which results in the victim death caused by delayed aid ,is the accomplicer with the traffic offencer. From our part, such provision needs to be deliberated and we will state our position in this dissertation.
