WTO反规避立法的前景及其对我国的启示

FOREGROUND AND ENLIGHTENMENT OF WTO ANTI-CIRCUMVENTION LEGISLATION

尽管现行WTO规则体系中并无统一的国际反规避立法,但从GATT反倾销法的历史和实践看,欧美在国际贸易中的特殊地位和影响以及欧美反规避立法的完善决定了以欧美意见为主导的反规避法迟早会被纳入WTO统一的反倾销协议中。我国加入WTO后系统构建反规避立法不仅极为必要,而且应根据WTO反规避立法动向和我国对外贸易的实际,尽可能地增强我国反规避立法的前瞻性。

There is not any material of international anti-circumvention law in WTO rule system , but according to the history and practice of the GATT anti-dumping law and the particular status and the force of America and Europe in international trade, it is without saying that the international anti-circumvention law by the view of America and Europe shall be brought into WTO ADA.Since China’s entry into WTO, it is very important to legislate Chinese anti-circumvention law. Furthermore, we should advance the foreseeable character as much as possible in light of the anti-circumvention trend of WTO and Chinese foreign trade fact.Key word:anti-circumvention;anti-dumping;perfection of legislation
