法律社会是法律学者力图构建的应然美好的正义之邦。社会学者的法律指的是调控社会秩序的实然规则。习俗社会是由实然的法律规则来主导运行的。习俗社会生长出习俗、惯例进而演化为习惯法。习俗与理想的法律之间有距离,也有相承之处。对于学校管理的变革,我们必然要追问其合理性、合法性与合习俗性与否。总之,学校管理应当在法律的理想框架下,寻找习俗的生长点。

The justice society is a perfect Utopia that jurists seek to construct. The sociologist puts forward that the law is the order operated in the custom society. The custom society grows the custom, tradition and unwritten law. The perfect law is away from the custom, yet they are conjoint. For the school management change, its rationality, validity and conventionality must be sought for. In a word, the school management change ought to search where the new custom is growing in the justice society.
