Social Control and Dispute Solution——Analysis about some Functions of the Chiness Supreme Court

在最高法院的功能体系内,纠纷解决是基本功能,而社会控制则属于延伸功能。就目前我国最高法院的功能来看,纠纷解决功能仍十分突出,尽管最高法院也在积极地拓展其延伸功能,但是受法院现代化进程的影响,其延伸功能被立法限定在一定的范围和程度内,因而功能的发挥非常有限。

The function of dispute solution is the Supreme Court's basc function,while the function of social control is only an extending function.At present,the function of dispute solution of the Chinese Supreme Court is still more serious,and the extending function is being reinforced because the extending function is limited to a certain range and degree by legislation in the process of court modernization.
