Liang Qi-chao's View and Application of Copyright

梁启超是维新运动领袖之一,逃亡日本期间,在康有为的支持下,主编《清议报》、《新民丛报》等刊物,并合办上海广智书局。在编辑实践中,他较早地接受并实践了西方先进的版权制度;身处日本,赞同日本与中国订立版权保护条约,主张中国通都大邑实行版权制度。在他回国以后的学术论著出版活动中,努力运用版权武器来争取自身的最大版权利益;于古书辨伪实践中,在某种程度上维护了古代著作权人的精神权利。

Liang Qi-chao was one of the leaders of the reform campaign at the end of the Qing dynasty.After he escaped to Japan,he compiled editorials such as Qing-Yi Newspaper,and Xin-Min-Cong,and founded Shanghai Guangzhi Publisher.In editing practice,he accepted and applied the advanced Western copyright system quite early.In Japan,he approved of the negotiation of copyright contract between Japan and China.He also advocated that Chinese large cities which had developed advanced traffic should carry out the copyright system.In his academic work publishing activities after he returned from Japan,he endeavored for his best copyright benefit.In identifying fake ancient books,he protected the spiritual right of ancient writers to some extent.
