Present Situation of Our Country’s Death Penalty and New Thought

在废除或限制死刑日益成为一种世界潮流的背景下,我国仍然保留了死刑,这是由当前中国的现实条件决定的。为了使我国的死刑控制与国际人权法的要求和世界刑罚轻缓化发展趋势相一致,笔者认为应从限制死刑适用范围、限制死刑适用对象范围、扩大死缓制度适用范围、收回死刑复核权几个方面加强立法完善。

When abolishing or limiting death penalty ecomes a world trend ,our country still reserves death penalty .It is decided by our current conditions . In order to make our nation’s death penalty control accord with international human right’s requirement and world punishment development,I think it should limit the scope of death penalty、limit the object of death penalty、expand the scope of death sentence with a two–year reprive and forced labour、withdraw the right of reviewing death penalty .
