关于我国民办高等学校营利性法人问题的探讨

Private Institutions of Higher Education as Profit-Making Enterprises in China

虽然在当前我国民办高等教育阶段还未见到注册为营利性法人的民办高等学校,但依据相关的法律、法规的精神,从我国民办高等学校的具体办学情况和国外私立高等学校的办学实际,从发展的角度看,我国民办高等学校应当可以成为营利性法人。

The author holds that, although the private institutions of higher education are not officially certified as profit-making enterprises in China, they are nevertheless essentially profit-making from the legal perspective, and experiences in the West show that private institutions of higher education in China may be established and developed in the similar way.
