摘要
仲裁与调解相结合纠纷解决制度是一种新型的纠纷解决方式,学术界争论的焦点有:仲裁与调解相结合是否混淆仲裁员与调解员的不同角色,是否违反了程序公正原则,能否提高纠纷处理效益。对其正当性可以运用纠纷解决中的“二重获得合意”理论进行证明。
The med-arb institution is a new way to settle disputes, and current arguments in theoretical circle focus on the following issues: whether the med-arb institution has mixed up the different roles of arbitrators and mediators; whether it has disobeyed the principle of procedural justice; whether it can improve the efficiency in settling disputes.This paper points out that the rationality of med-arb institution can be demonstrated by applying the theory of acquirement of dual agreement.
