强调法律全球化、构建社会主义和谐社会,必须关注法律移植问题。但是法律移植必须与本土资源有机地结合。诉辩交易和ADR对于建立中国特色的行政协商制度具有重大借鉴价值。行政协商的基本特征是在救济程序中的自主性。它在主体上排除了审查机关的居中调解。这样是为了体现行政协商的真实内涵,避免审查机关调解的弊端。行政协商可以贯穿于审查程序的整个过程。但是行政协商的内容不得涉及行政行为的性质。审查机关可以根据当事人的协商意见,直接终结审查程序。终结决定具有终局性。

Emphasize legal globalization,legal transplantation have to be concerned.But the legal transplantation has to unite against the Domestic resources.The plea-bargaining and ADR have reference value for establishing the Chinese administration consultation system.The administration consultation's basic character is an autonomy in the succor process.With the subject,the administration consultation remove the mediate by the censorship department between two parties. It is like this the real connotation for the administration consultation ,avert the corrupt of the mediate by the censorship department.The administration consultation may penetrate the entire process to the audit program , but the administration consultation substance must not relate to administration action nature .The censorship department may final censorship program immediately according to the opinion of the party , the resolution is final.
