摘要
对于企业员工在任职期间泄露商业秘密、跳槽带走商业秘密从而可能会给企业带来不利影响的行为,企业会通过订立包含有保密义务或竞业禁止条款内容的合同等来自行保护,相关立法也顷向保护用人单位的权益。而该文主要是从劳动者的角度,探讨作为劳动者应如何在竞业禁止中保护自身的合法权益。
With contracts containing articles about secrecy or prohibition of business strife, the enterprises can prevent the disadvantageous case that the employees reveal the business secrets during the term of office or take away the business secrets in job-hopping. And relative laws tend to protect the rights of these enterprises. From the angle of the laborers, the thesis discusses how the laborers can protect their own rights in the prohibition of business strife.
