Comparative Research on the Products Liability in Regard to the Damage Compensation Extent

产品责任损害赔偿范围既关系到受害人的赔偿请求得到满足的程度,又关系到生产者承担赔偿责任的轻重。我国产品责任赔偿范围与美国、欧洲国家相比,存在赔偿数额低、惩罚性赔偿制度不完善、赔偿额没有最高最低限制等问题,应从立法上予以完善。

The damage compensation extent of the products liability is related to not only the sufferer's satisfaction of his or her compensation request,but also the producer's liability from the compensation.Compared with the European countries and the America,the extent of the products liability compensation in China has some problems,for example,the compensation amount is low,the punitive damage regulation is not perfect,and the compensation amount has not any limit,all of the above should be perfected by legislation.
