摘要
“作为整体的法律”或者“建构性的解释”,坚持法律的要求是阐释性的判断,因为法官要通过其他法官对法律的阐释来决定什么是法律。理解作为整体的法律理论离不开对以下几个问题的探讨:整体性、原则论、阐释学及法律的唯一正解。通过这种途径得到的法律概念是完整的法律,这是一个开放的、包容性较强的、多层次的系统。这样的法律观实现了在法律的安定性和对法律的通权达变的要求之间的切换和转接,最终目的则在于调节社会多方面的利益,以增进共同生活的福祉。
“Law as integrity” or “constructive interpretation” insists that the demand of law is an interpretative evaluation. Understanding the theory of law as integrity can not be departed from the discussions about the following questions: integrity, principles, hermeneutic and the only right answer to law. Alegal concept acquired through this way is an integrate one and it is an open and magnanimous system with multi-levels. This legal concept has realized the shifting and meeting between law’s invariability and the need for its changing. Its ultimate goal lies in regulating the multi-benefits of the society and building up common welfare.
