作为规范用人单位与劳动者关系的劳动法,目前的规定,特别是劳动合同的规范有很多不足之处。本文主要从 劳动法本质的辨析,劳动合同的缔结及稳定等方面存在的问题,依市场经济的基本要求进行了探讨。

Labor law is a law which adjusts relationship between units and laborers,it has conducted for ten years in our country. However, it exits many deficiencies as a standard of labor contract. This article analyzes some problems such as the nature of labor law, establishment and stability of labor contract according to the foundational demand of market ec%onomy, and also puts forward my opinions about how to perfect labor contract.
