摘要
本文通过一些较为直观的数字对停车位的现状给予了关注,并对有关区分所有建筑附属停车位的权属问题从我国传统民法和比较法的角度给予论述,揭示了现行法律与现实问题之间的矛盾。通过综合分析,作者提出了立法借鉴之思路。
A picture of parking space shortage in the city is presented with statistics in the paper. Discussions on the property right of attached parking space of condominium building are made from the perspectives of conventional civil law and comparative law. And contradictions between current laws and practices are revealed, which is followed by suggestions on legislative borrowing.
