关于高等学校自主管理权程序控制的思考

Pondering on the Procedure Control over Universities' Right of Autonomous Administration

高等学校自主管理权是高校依法享有的为保证其目标的实现而对其内部事务进行处置的特别权力,但它与其他行政权力一样具有潜在的扩张性和滥用的可能性,容易导致对师生合法权利的侵害。高校自主管理权行使过程中存在着管理行为不合法、管理制度落后、程序不规范、随意性以及忽视学术权力等问题,应在立法控制和司法控制的基础上积极实施程序控制,从而有效抑制高校自主管理权的滥用。

In China, colleges and universities are legitimately granted a right of autonomous administration, a privilege for them to handle their inner affairs independently in order to fulfill their educational purpose. However, as is true with other administrative rights, the above related right also has the potential of expansion and abuse, which is liable to bring about infringement to legal rights of teachers and students. In the execution of this autonomous right, there exists such negative problems as illegal administrative conducts, backward administrative institutions, non-standard procedures, arbitrariness and ignorance of academic rights. Consequently, we should implement the procedure control actively on the basis of legislative and judicial control, thus effectively restrict the abuse of colleges and universities' right of autonomous administration.
