Study on Combination between Traditional Law Culture and Modern Rule by Law in China

传统法文化作为一种观念形态对现代法治的实现具有深刻影响,而且主要是消极影响这点是不言而喻的。要把我国建设成为社会主义现代化国家,一个重要的目标就是实现我国社会生活的法治状态,而不解决好传统文化对现代法治的影响这个关键问题,这个目标是很难实现的。文章试图从分析我国传统法文化形成原因入手,来阐述我国传统法文化与现代法治整合对我国实现法治的重要性,重点阐述了我国传统法文化与现代法治整合的途径及意义,目的在于为我国现代法治社会的建立出谋划策。

It gose without saying that: as a kind of conception form, traditional law culture deeply influences its realization of contemporary rule by law, negatively. It is difficult to realize rule by law in our country without resolving the influence of traditional law culture. This article attempts to start with analysis of reasons of our traditional culture form, to expound the importance of the combination of traditional law culture and modern civilization of rule by law. The emphasis is put on the combination of the two. The goal is to do a favor for the realization of rule by law of our country.
