我国他物权体系的建立对于经济社会的存在和发展具有极为重要的意义。在我国现行立法中没有明确的他物权概念,也未建立一套科学、完整的他物权体系。本文就适应我国经济社会发展的实际情况及发展趋势、体现现有法律概念和法律规定、研究立法技术等方面,对构建我国他物权体系应考虑的几个主要因素进行了探讨。

The establishment of our country’s his real right system for the existence of economy and developments of the society is of great importance. There is no explicit his real right concept in current lawmaking in our country, and China also did not build up a set of scientific and integrated his real right system. This article reconsiders his real right system under the current circumstances.
