摘要 分时度假的营销阶段是发生纠纷的多事环节,开发商或销售商的营销行为严重损害了消费者权益,立法规制势在必行。规制分时度假营销的具体方法就是,必须建立冷却期规则、虚假广告禁止规则和有奖促销规则,防止开发商或销售商的强迫性销售、欺骗性销售,从而保护购买人合法权益,建立良性运行的分时度假市场秩序。 The marketing phase in timesharing often causes conflicts.The behavior of developer and salers damage greatly the consumers' rights and interests, so the legistration of timesharing is imperative under the situation. The specific methodology of the legistration is to establish regulations on cool-off time, prohibition of fraudulent ads and prize promotional sales so as to prevent the compulsive sales as well as fraudulence from the developers and salers. The legislation of timesharing purposes is, therefore, to protect the rights and interests of the buyers and to establish a favorable market order of timesharing.
