试论我国社会转型时期夫妻人身关系

Discussion on Matrimonial Relationship During the Social Transiting Period of China

社会转型时期,我国夫妻人身关系出现了许多问题。文章在分析其产生及其危害性以及目前我国有关夫妻人身关系立法和执法机制不健全的基础上,提出了完善我国夫妻人身关系法律调控机制必须从立法和执法方面采取措施,并对完善我国夫妻人身关系的立法和执法措施提出了基本构想。

The article analyzes the striking problems on the matrimonial relationship during current social transiting period of our country. Based on analysis of its emergence, harm and the inadequacy of related legislation and execution mechanism, the paper puts forward that the legal mechanism on matrimonial relationship should take measures in lawmaking and execution, and proposes some basic ways to improve the lawmaking and execution measures.
