死刑复核程序之弊端随着审判方式改革的推进日益凸显,改革呼声日涨,最高人民法院适时推动立法进程,决定收回死刑核准权。但此项措施并不能根本解决问题。从宏观和长远考虑,应建构包含死刑复核审的三审终审制。

The drawback of the procedure for review of death sentence is prominent day by day with the promotion of the adjudication method reform.The Supreme People's Court promotes the legislative process on time,regaining death penalty check and approve right.But this measure can not solve the problem essentially.For macroscopic and long-term consideration,the system of examining last instance three times including death penalty checking should be constructed.
